By creating an account or using the services provided by StatusBird LLC ("Company," "we," "us," or "our") at statusbird.io (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

StatusBird provides website uptime monitoring and notification services. We check your specified URLs at regular intervals and attempt to notify you via SMS or email if we detect downtime.

Limitations: You acknowledge that our monitoring service relies on third-party networks (internet providers, Twilio for SMS, email servers) and may experience delays or failures. We do not guarantee 100% accuracy or delivery of alerts.

3. Accounts and Registration

To use the Service, you must register for an account. You agree to:

• Provide accurate and current information.
• Maintain the security of your password.
• Take full responsibility for all activities that occur under your account.

4. SMS and Communications

By adding a phone number to your account, you consent to receive SMS text messages from StatusBird related to your website's status.

• Message frequency: Varies based on your site's uptime.
• Cost: Message and data rates may apply depending on your carrier plan.

You may opt-out of SMS alerts at any time by replying "STOP" to any message or removing your phone number in the dashboard.

5. Payment and Subscription

Billing: Services are billed on a subscription basis (monthly or annually). Payments are processed securely via Stripe. We do not store your credit card information.

Renewal: Your subscription will automatically renew at the end of each billing cycle unless canceled.

Cancellation: You may cancel your subscription at any time via your account dashboard. You will continue to have access to the Service through the end of your current billing period.

Refunds: Payments are non-refundable, except where required by law.

6. Prohibited Use

You agree not to use StatusBird to monitor:

• Websites involving illegal activities.
• Websites that you do not own or do not have permission to monitor.
• Government or military infrastructure.

We reserve the right to terminate your account immediately if you violate these rules.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." STATUSBIRD LLC MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR FALSE POSITIVES (ALERTS WHEN SITE IS UP) OR FALSE NEGATIVES (FAILING TO ALERT WHEN SITE IS DOWN).

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STATUSBIRD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
